Publishing, Copyright, and Citation Guidelines

Extracts from archival documents should be cited as follows:

Special Collections: Archives and Rare Books materials may be used in research, teaching, exhibitions, publications, websites, films, and other projects. Researchers are responsible for citing materials clearly, requesting permission when required, and ensuring that their use complies with copyright, privacy, defamation, and other applicable laws.

Citing Archival Materials

Extracts from archival documents should be cited using the following format:

[Collection name, box and folder number, Special Collections: Archives and Rare Books, John M. Kelly Library, University of St. Michael’s College.]

If you use microform or photocopied documents, please also cite the repository that holds the original material.

Credit Line for Images and Other Reproductions

A credit line must accompany the reproduction of any pictorial material from Special Collections: Archives and Rare Books. The credit line should appear on the same page as the image, or as close as possible so that it is immediately clear to the reader, user, or viewer.

For television, films, audio-visual productions, websites, exhibitions, and similar uses, a prominent credit in the opening or closing credits is acceptable.

Permission to Publish

Permission to copy, quote from, or publish Special Collections: Archives and Rare Books materials does not transfer ownership or rights in the material. The library retains the right to publish materials in its care and to grant permission to others when it is able to do so.

Researchers planning to publish, exhibit, reproduce, or otherwise share Special Collections: Archives and Rare Books materials should contact staff before publication. A written request may be required when the exact material to be used has been identified.

Permission from the Kelly library must be obtained before unpublished documents from Special Collections: Archives and Rare Books are published.

Copyright and Other Rights

Researchers are responsible for determining whether materials are protected by copyright and for obtaining permission from copyright owners when required. Literary rights to unpublished materials remain with the authors, heirs, or assignees unless those rights have been transferred.

Permission from Special Collections: Archives and Rare Books does not replace the need to obtain permission from the copyright owner. Copyright owners may charge additional fees, even when staff are able to provide a reproduction or grant permission for use of the physical item.

Researchers are also responsible for privacy, defamation, and other legal issues that may arise from copying, publishing, exhibiting, or otherwise using Special Collections: Archives and Rare Books materials.

Public Domain Materials

If the requested material is in the public domain, the library does not charge a rights or use fee and permission to publish is not required. Researchers should still cite the material clearly and include the appropriate credit line.

Reproductions for Publication

Researchers wishing to reproduce photographs, maps, audio-visual materials, or other Special Collections: Archives and Rare Books materials for publication must complete the relevant request forms.

Copy of Publication

If your publication relies heavily on Special Collections: Archives and Rare Books materials, we request that one copy be donated to the John M. Kelly Library once the work is published.
